Terms and Conditions

Effective date: 04/02/2026

These Terms and Conditions (“Terms”) govern your use of services provided by Central Texas Waste (“Company,” “we,” “us,” or “our”), a Texas business. By requesting or using our services (including but not limited to junk removal, dump trailer rentals, property cleanouts, yard waste removal, contractor services, light demolition, and related services), you agree to these Terms.

1. Services

We provide full‑service and self‑service options as described in our service materials. Service descriptions, estimates, and schedules are subject to change based on site conditions, access, load size, and applicable laws. We reserve the right to refuse service for unsafe conditions or prohibited items.

2. Estimates, Rates & Payment

- Estimates: Written or electronic estimates are provided on request and are valid for the period stated in the estimate. Estimates are not final until confirmed in writing or by payment of required deposit.

- Rates: Rates may be hourly, flat, by load, or by weight. Additional fees (delivery/pickup, disposal, overage, fuel, travel, permits, special handling) may apply.

- Payment: Payment is due upon completion of service unless otherwise agreed in writing. We accept cash, major credit/debit cards, and approved electronic payments. Returned payments incur fees.

- Deposits: Certain services (rentals, large cleanouts, scheduled demolition) require a deposit to secure the booking. Deposit amounts and refundability are specified at booking.

3. Booking, Access & Site Conditions

- Access: You must provide safe, legal access to the work area and disclose any site hazards (underground utilities, asbestos, chemicals, animals). We are not responsible for delays or extra charges for inaccessible sites.

- Permits: Customer is responsible for obtaining required permits unless otherwise agreed in writing.

- Property Condition: Inform us of any fragile landscaping, utilities, or property features. We are not liable for pre‑existing damage or damage resulting from unavoidable contact during service.

4. Prohibited & Regulated Items

We will not accept hazardous, illegal, or regulated materials unless specifically arranged and permitted. Prohibited items include, without limitation: explosives, radioactive materials, PCB‑containing items, certain solvents, large quantities of fuel, medical waste, biohazardous materials, and certain batteries or refrigerants unless removed by certified technicians. If prohibited items are discovered, additional charges may apply and we may refuse to remove them.

5. Dump Trailer Rentals & Equipment Use

- Use & Responsibility: Renters are responsible for proper use of rented equipment, securing loads, and complying with weight limits and law. Do not overload trailers.

- Damage & Loss: Renter is liable for damage, loss, theft, and excessive cleaning fees. Report damage immediately.

- Insurance: Renters should maintain appropriate insurance for rented equipment and jobsite operations. We may require proof of insurance for certain rentals.

6. Cancellation Policy

- Service Appointments (non‑rental): Cancellations made at least 24 hours before the scheduled appointment are fully refundable for any paid deposit. Cancellations made less than 24 hours before the appointment may forfeit the deposit or be subject to a cancellation fee of $75

- Dump Trailer Rentals:

- Daily/Short‑Term Rentals: Cancellations made at least 48 hours prior to the scheduled pickup are fully refundable for any paid deposit. Cancellations within 48 hours of pickup forfeit the deposit.

- Weekend/Weekly Rentals: Cancellations made at least 72 hours prior to scheduled pickup are fully refundable for any paid deposit. Cancellations within 72 hours forfeit the deposit.

- Same‑Day Bookings & Emergency Services: Non‑refundable unless we cancel due to our inability to perform.

- Rescheduling: Rescheduling is allowed subject to availability; reschedules within the cancellation windows above may be treated as cancellations.

- Refunds: Refunds will be returned to the original payment method within a reasonable period (up to 14 business days) after approval.

7. Changes & Additional Charges

If actual job conditions differ from the estimate (extra volume, hidden materials, hazardous items, extended labor), we will notify you and obtain authorization for additional work and fees. If you cannot be reached, we may stop work and reschedule.

8. Limitation of Liability

To the maximum extent permitted by law, our liability for any claim arising from services is limited to the total amount paid by you for the specific service giving rise to the claim. We are not liable for consequential, incidental, special, punitive, or indirect damages, including lost profits.

9. Indemnification

You agree to indemnify, defend, and hold harmless Central Texas Waste and its agents, employees, and contractors from any claims, liabilities, losses, damages, and expenses (including reasonable attorney fees) arising from your breach of these Terms, negligence, willful misconduct, or violation of law.

10. Insurance & Risk Transfer

We maintain general liability coverage for our operations. You are responsible for insurance covering your property and operations, and for notifying your insurer if required. Risk of loss for rented equipment transfers to renter at delivery.

11. Dispute Resolution

- Informal Resolution: Please contact us to resolve disputes promptly.

- Governing Law: These Terms are governed by the laws of the State of Texas without regard to conflict‑of‑law principles.

- Venue: Any legal action arising from these Terms shall be brought in state or federal courts located in Travis County, Texas (or county where the service was performed), and you consent to exclusive jurisdiction there.

- Attorneys’ Fees: The prevailing party in any legal action to enforce these Terms is entitled to recover reasonable attorneys’ fees and costs.

12. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using our services you consent to the collection and use of personal data as described in that policy.

13. Photos, Videos & Testimonials

We may take photos or videos of job sites for documentation, training, marketing, or billing. We will not publish identifying images without consent where required by law. Contact us to request removal.

14. Termination

We may suspend or terminate services or refuse future service for nonpayment, violation of these Terms, unsafe conditions, or other reasonable business reasons. Termination does not relieve you of payment obligations for services already rendered.

15. Severability & Waiver

If any provision is held invalid or unenforceable, the remaining provisions remain in effect. Failure to enforce any provision is not a waiver of rights.

16. Changes to Terms

We may update these Terms. Material changes will be posted with an updated effective date. Continued use of our services after changes constitutes acceptance.

By booking or using our services you acknowledge that you have read, understood, and agree to these Terms and Conditions.
